- All patios must adhere to the requirements of the Accessibility for Ontarians with Disabilities Act including a minimum clearance of 1.5 metres to permit pedestrian access.
- A removable fence shall be erected to clearly delineate the area on the sidewalk being used for the patio and sidewalk extensions.
- On-street sidewalk extensions and patios occupying a portion of the road or parking space(s) may require roadside safety barriers.
- On-street extensions are limited to occupying one parking space per establishment and cannot occupy any barrier-free parking space.
- One additional parking space may be permitted with written consent of the neighbouring property owner.
- Patios are permitted to operate only during normal business hours and must cease operation by 11 p.m.
- Patios with supporting posts (e.g. wooden deck or roof structure) may require a building permit
- On-street patios must be a minimum of 10 metres from an intersection.
Seasonal Sidewalk and On-Street Patio Program
Our Seasonal Sidewalk and On-Street Patio Program permits local businesses to operate a seasonal patio on the sidewalk or street parking area.

Applicants are encouraged to connect with our economic development and tourism team for review before submitting their application.
Eligible businesses include eating and drinking establishments as well as micro-breweries.
The program is intended for public properties in defined downtown areas, however, if you want to open a patio on private property or in a commercial or rural area, contact us to review your options.
The permit is valid from Apr. 1 to Nov. 30 and must be renewed annually.
Application process
- The application process is administered by our Economic Development and Tourism division. Applicants are encouraged to reach out with any questions and to review their application.
- All applications are reviewed by an inter-departmental committee as well as the Accessibility Advisory Committee.
- If approved to proceed, you can then construct the patio area, but before we issue a permit, your patio must pass an inspection, and you must comply with any needed additional requirements.
- Once a permit is issued, you must ensure it’s posted onsite at all times.
The applicant must meet all legislative and licensing requirements that would normally be required to operate the establishment (e.g. Health Unit, Alcohol and Gaming Commission of Ontario, Ontario Building Code, etc.)
You will also need to submit supporting materials along with your application:
- Copy of certificate of insurance showing a policy valid during permit dates
- Application fee
- Patio concept diagram
- Photos of the previous year’s patio (for renewals)
Fees
2024 application fees:
- First-time (full application) fee - $321 + HST
- Renewal fee - $113 + HST
The renewal fee is only applicable for applications with no substantial changes from the previous year. If there are substantial changes (such as increased seating or capacity, relocation of patio, etc.), then the full application fee applies.
Building permit and/or safety barrier fees may also be required and are determined on a case-by-case basis.
